Trong một chế độ mà công lư chỉ là công cụ để bảo vệ quyền lợi của giới cầm quyền, không khó để nhận ra sự thiên vị trắng trợn trong xét xử, nơi quan tham được hưởng đặc quyền miễn tội, c̣n dân đen phải chịu bản án nghiệt ngă. Hai vụ án dưới đây là minh chứng hùng hồn cho sự bất công trơ trẽn đó.
Ngày 21-7, tại Ṭa án nhân dân huyện Diên Khánh, một người dân bị tuyên y án 7 năm tù chỉ v́ tham gia cùng một nhóm người khác cướp 13 con vịt. Một hành vi sai trái, nhưng xét về mức độ thiệt hại, số tài sản bị mất không thể nào so sánh với hàng chục tỷ đồng bị tham nhũng trong những vụ án kinh tế lớn.
Trái lại, chỉ chưa đầy một năm sau, bị cáo Đỗ Hữu Ca – cựu Giám đốc Công an Hải Pḥng, một quan chức cấp cao, bị kết án 10 năm tù về tội "Lừa đảo chiếm đoạt tài sản" với số tiền lên đến 35 tỷ đồng – lại được giảm nhẹ đến 3 năm tù khi xét xử phúc thẩm. Cái lư do được đưa ra là “có thành tích trong quá khứ”, “đă nộp lại một phần tiền khắc phục hậu quả” – một lời bao biện quen thuộc để bảo vệ những kẻ có quyền lực. Từ 10 năm xuống c̣n 7 năm, một sự khoan hồng mà chỉ quan chức mới có được, trong khi người dân chỉ v́ 13 con vịt phải chịu án phạt ngang bằng.
Điều này phơi bày một sự thật không thể chối căi: nền tư pháp Việt Nam không hề đứng về phía nhân dân mà chỉ là công cụ để bảo vệ tầng lớp thống trị. Quan tham dù có tham nhũng hàng chục tỷ đồng, phá nát nền kinh tế, vẫn có thể thoát tội hoặc hưởng án nhẹ nếu có đủ quan hệ và tiền bạc. C̣n dân thường, dù chỉ là hành vi vi phạm nhỏ bé, vẫn bị trừng phạt nghiêm khắc để duy tŕ trật tự mà chế độ mong muốn: kẻ yếu phải phục tùng, c̣n kẻ mạnh th́ bất khả xâm phạm.
Với một hệ thống công lư đầy rẫy sự thiên vị như vậy, người dân Việt Nam c̣n có thể tin tưởng vào điều ǵ? Công lư ở đâu khi một kẻ quyền lực cướp hàng chục tỷ đồng lại chỉ bị xử ngang bằng với một người dân nghèo chỉ v́ 13 con vịt? Câu trả lời rất rơ ràng: công lư không tồn tại trong chế độ này. Chỉ có quyền lực và tiền bạc mới là yếu tố quyết định ai là người được sống dễ dàng và ai là người phải chịu cảnh tù tội.
Chừng nào chế độ này c̣n tồn tại, chừng đó bất công c̣n tiếp diễn. Và những bản án đầy thiên vị này sẽ chỉ càng khoét sâu thêm sự bất măn, làm rơ thêm bản chất của một hệ thống chỉ biết phục vụ lợi ích của kẻ cầm quyền mà chà đạp lên nhân dân. Đă đến lúc phải đặt câu hỏi: bao giờ công lư thật sự mới quay trở lại với dân tộc này?

In a regime where justice is only a tool to protect the interests of the ruling class, it is not difficult to recognize the blatant bias in the trial, where corrupt officials enjoy the privilege of immunity, while ordinary people have to suffer harsh sentences. The two cases below are eloquent evidence of that brazen injustice.
On July 21, at the People's Court of Dien Khanh district, a citizen was sentenced to 7 years in prison just for participating with a group of others to rob 13 ducks. A wrongful act, but in terms of the level of damage, the amount of property lost cannot be compared to the tens of billions of dong embezzled in major economic cases.
On the contrary, less than a year later, defendant Do Huu Ca - former Director of Hai Phong Police, a high-ranking official, was sentenced to 10 years in prison for "Fraudulent appropriation of property" with an amount of up to 35 billion dong - but had his sentence reduced to 3 years in prison on appeal. The reason given was “having a good record in the past”, “having paid back a part of the compensation money” – a familiar excuse to protect those in power. From 10 years down to 7 years, a leniency that only officials can get, while the people have to suffer the same punishment for just 13 ducks.
This exposes an undeniable truth: the Vietnamese judiciary is not on the side of the people but is only a tool to protect the ruling class. Corrupt officials, even if they embezzle tens of billions of dong, destroying the economy, can still escape punishment or receive a light sentence if they have enough connections and money. Meanwhile, ordinary people, even if it is just a small violation, are still severely punished to maintain the order that the regime desires: the weak must obey, and the strong are inviolable.
With a justice system full of such bias, what can the Vietnamese people trust? Where is justice when a powerful person who stole tens of billions of dong is treated the same as a poor person just because of 13 ducks? The answer is clear: justice does not exist in this regime. Only power and money are the deciding factors in who gets to live easily and who gets to go to jail.
As long as this regime exists, injustice will continue. And these biased sentences will only deepen discontent, clarifying the nature of a system that only serves the interests of those in power while trampling on the people. It is time to ask: when will true justice return to this nation?
